US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The situation originates in a erroneous removal to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to face human smuggling allegations, he was held in federal custody.

In her order, the court pointed out that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The court proceedings center on disputed assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.

Conditions of Freedom

The court, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the Tennessee court.
